This Privacy Policy explains how Black Fox Express Inc. and the TruckBinder platform (“we,” “us,” or “our”) collect, use, store, and disclose information obtained through our websites, online driver applications, the TruckBinder mobile application, and related services.
This policy applies to users of TruckBinder, driver applicants, drivers, managers, administrators, and other individuals who provide information through our services.
1. INFORMATION WE COLLECT
Depending on how you interact with us, we may collect the following categories of information:
Personal and Contact Information
• Full name
• Email address
• Phone number
• Mailing or residential address
• Date of birth
• Electronic signature and date of submission
Driver Qualification Information
• Commercial Driver’s License (CDL) number
• CDL state, class, endorsements, and expiration date
• Medical certificate information and expiration date
• Driving experience
• Accident and violation information
• License suspension or revocation information
• Drug and alcohol testing information provided as part of the driver qualification process
• Motor Vehicle Record (MVR) review information
• Clearinghouse-related compliance information

Employment and Application Information

TruckBinder Account Information
• User account identifiers

TruckBinder may store documents and records such as:

• Driver qualification documents

Photos, Scans, and Submitted Documents
TruckBinder may process photographs and documents intentionally submitted by users, including:
• Proof of Delivery (POD)
• Lumper receipts
• Other receipts
• Pre-Trip Inspection (PTI) photographs
• Truck and trailer photographs
• Other transportation-related documents
Lumper Information
When a user submits a lumper receipt, we may process information such as:
• Lumper amount
• Who paid the lumper
• Associated receipt or document
• Driver and submission information
Technical Information
We and our service providers may process limited technical information necessary to operate and secure our services, such as:
• Device or application identifiers
• Authentication information
• Login activity
• Push notification tokens
• Diagnostic and technical information
2. HOW WE USE INFORMATION
We may use information to:
• Process and evaluate driver applications
• Verify driver qualifications and employment history
• Manage recruiting and onboarding
• Authenticate users and maintain accounts
• Manage driver, truck, trailer, and company records
• Maintain driver qualification and compliance information
• Track credential, inspection, registration, and insurance expiration dates
• Provide Electronic Binder functionality
• Process Pre-Trip Inspection (PTI) requests and photographs
• Process Scan & Send submissions
• Process PODs, lumper receipts, receipts, and related transportation documents
• Send documents and operational notifications to authorized recipients
• Support transportation safety and regulatory compliance
• Maintain security and prevent unauthorized access
• Troubleshoot and improve our services
• Comply with applicable legal and regulatory requirements
We do not sell personal information collected through TruckBinder or our driver application.
We do not use uploaded driver documents, PTI photographs, PODs, or similar records for advertising purposes.
3. DRIVER APPLICANTS
Information submitted through a driver application may be used to evaluate an applicant’s qualifications for employment or engagement as a commercial driver.
Where permitted or required by law, information may be used to verify employment history, driving history, safety performance, licensing information, and other qualifications.
Information may be shared with previous employers, authorized screening or verification providers, government or regulatory services, and other parties when necessary or legally permitted for driver qualification and compliance purposes.
Certain background reports, driving records, drug and alcohol records, or similar information may require separate disclosures or authorizations. The privacy acknowledgment contained in a driver application does not replace any separate authorization required by applicable law.
4. CAMERA AND PHOTO ACCESS
TruckBinder may request access to a device camera for features that allow users to photograph documents, receipts, vehicles, trailers, or inspection items.
Camera access is used only when the user chooses to use a feature requiring the camera.
Users may manage camera permissions through their device settings. Disabling camera access may prevent certain TruckBinder features from functioning.
5. HOW INFORMATION MAY BE SHARED
Information may be accessible to authorized administrators, managers, company representatives, or other users according to their assigned permissions and company relationship.
We may also use third-party service providers to operate our services, including providers of:
• Cloud hosting and databases
• Authentication
• File storage
• Email delivery
• Push notifications
• Technical infrastructure and security
These providers may process information as necessary to provide services on our behalf.
Information may also be disclosed when required by applicable law, regulation, court order, subpoena, or other valid legal process, or when reasonably necessary to protect rights, safety, security, or prevent fraud.
6. GOOGLE FIREBASE AND CLOUD SERVICES
TruckBinder uses Google Firebase and related Google Cloud services for functionality that may include authentication, databases, cloud file storage, backend processing, and notifications.
Information processed through these services may be transmitted to and stored on infrastructure operated by Google and its service providers.
7. EMAIL DELIVERY
Certain TruckBinder functions send documents or operational information by email.
For example, Scan & Send submissions and PTI notifications may be delivered to authorized recipients.
An email delivery service provider may process recipient email addresses and information necessary to deliver these messages.
8. DATA SECURITY
We use reasonable administrative, technical, and organizational measures designed to protect personal information.
These measures may include authenticated access, role-based permissions, secure cloud infrastructure, access restrictions, and secure network transmission.
However, no electronic storage or transmission system can be guaranteed to be completely secure.
Users are responsible for protecting their account credentials and should not share passwords with unauthorized persons.
9. DATA RETENTION
We retain information for as long as reasonably necessary to provide our services, maintain business and transportation records, comply with applicable legal and regulatory requirements, resolve disputes, maintain safety and compliance records, and enforce agreements.
Retention periods may vary depending on the type of record and applicable legal or regulatory requirements.
Information that is no longer required may be deleted or anonymized, subject to applicable retention obligations.
Certain temporary files or access links may be retained for shorter periods based on the functionality of the service.
10. ACCOUNT AND DATA DELETION
Users may request deletion of their account or personal information by contacting us using the information below.
Certain information may need to be retained when required for legal, regulatory, safety, compliance, fraud-prevention, or legitimate business recordkeeping purposes.
When no retention requirement or other lawful basis for retention applies, eligible personal information will be deleted within a reasonable period.
11. USER CHOICES AND DEVICE PERMISSIONS
Users can manage certain device permissions, including camera permissions, through their device settings.
Users may contact us to request access, correction, or deletion of personal information, subject to applicable law and record-retention requirements.
12. CHILDREN’S PRIVACY
TruckBinder and our commercial driver application are intended for adults and business users in the transportation industry.
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
13. THIRD-PARTY SERVICES
Our services may rely on third-party technology and service providers.
Those providers may process information according to their applicable privacy practices and their agreements with us.
14. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy when our services, practices, or legal requirements change.
When this Privacy Policy is updated, the Effective Date at the top of this page will be revised.
